Refusal of Service
BubbleMax reserves the right at its sole discretion to refuse service to anyone as required. The customer must meet all the requirements specified in these terms and conditions.
Pre-Payment
BubbleMax requires that you make a non-refundable pre-payment of a minimum of 15% of your project's quoted value or $20, whichever is larger, before starting your project. The pre-payment is a certification that you wish to continue with the project and is to prevent fraud against BubbleMax.
Payment Methods
BubbleMax currently accepts payments via PayPal, Money Order or Personal Cheques.
PayPal:
We require that you have a verified PayPal account if you wish to pay with PayPal. eChecks must be cleared before we begin processing your project.
PayPal is the recommended method of payment to speed up service.
Money Orders/Personal Cheques:
Money Orders can be used as a form of payment. Please contact us for more details.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold BubbleMax (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against BubbleMax, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless BubbleMax against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with BubbleMax; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement. Customer agrees to limit the liability of BubbleMax to the amount paid for service.
Refund and Cancellation Policy
Cancellation can be made at anytime during your order, however, the pre-payment made WILL NOT be refunded. All rights for the content created before your cancellation is that of BubbleMax and may be sold to another party. Refunds will only be made in extreme circumstances, to the discretion of BubbleMax, however, refunds are not made often. There WILL NOT be any refund of the pre-payment under any circumstance.
Disclaimer
BubbleMax will not be responsible for any damages your business may suffer. BubbleMax makes no warranties of any kind, expressed or implied for services we provide. BubbleMax disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by BubbleMax and its employees.
BubbleMax keeps daily backups of their data. BubbleMax can accept no responsibility for any loss of data or consequences arising from this.
Finally, BubbleMax wishes to emphasize that in accepting services, customers indemnify BubbleMax for the violation of any law or BubbleMax policy, that results in loss to BubbleMax or the bringing of any claim against BubbleMaxx. This means that if Bubblemax is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against Bubble, plus costs and reasonable legal fees.
BubbleMax reserves the right to change, edit, or update the policies contained in this document, along with the content on our website at any time for any reason without notice.
Privacy Policy
Bubblemax WILL NOT in any circumstance sell or give any of your information provided to us to any third party without your explicit consent.
The only third party that may recieve some of your information is PayPal Inc. for payment requirements.
